Terms of Service

1. The Service

Swimmy File is a file-sharing service. Users can upload files, receive one shareable link, and make content public in Discover or accessible only by direct link.

2. Accounts

• You must provide a valid email address and verify it before uploading content.
• You are responsible for keeping your account credentials secure.
• Only one account is permitted per person. Multiple accounts used to evade limits or a ban are prohibited.

3. Uploads and Storage

• New accounts are currently limited to 5 uploads per day, 2GB per file and 10GB total storage. Limits may increase with account trust.
• Files may be deleted automatically after their configured expiration period.
• The Company may generate thumbnails and use third-party cloud infrastructure such as AWS S3 or CloudFront to operate the Service.

4. Prohibited Content and Conduct

You may not upload, share or link to content that:

• Infringes copyright or other intellectual property rights;
• Is illegal or sexually exploits minors;
• Constitutes harassment, threats or violent content;
• Uses spam, scraping, bots, automated access or bulk methods to abuse the Service or circumvent limits;
• Contains malware or is intended to harm the Service, devices or users.

5. Reporting and Moderation

Users may report copyright infringement, spam, adult content, violence or other concerns. The Company may hide, remove or restrict content and suspend or ban accounts that violate these Terms. New public content may undergo review before appearing in Discover.

6. Copyright / Rights Holder Requests

If you believe content infringes your copyright, submit a request through Support, select the copyright category and provide enough information to identify the content and your claim. The Company may remove content while investigating.

7. Content Ownership and License

You retain ownership of uploaded content. You grant the Company a limited license to host, store and display it only as needed to operate the Service, including playback, thumbnail generation and display in Discover when public.

8. Limits, Deletion and Termination

The Company may limit uploads, downloads, storage or traffic to prevent abuse, security incidents or unexpected cost spikes. Expired files may be deleted automatically. Users can delete their uploads and accounts through the available controls. The Company may remove content or suspend or terminate accounts that violate these Terms, with or without notice.

9. Disclaimers and Limitation of Liability

The Service is provided as is, without warranties. To the maximum extent allowed by law, the Company is not liable for indirect, incidental or consequential damages arising from use of the Service.

10. Changes to these Terms

The Company may update these Terms. Continued use after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

The governing law and jurisdiction will be specified by the Company.
